Lindsay Clancy’s attorney on Monday called on the judge who oversaw her mistrial to investigate the holdout juror, claiming he may have inaccurately filled out jury forms or answered questions during the selection process.

Kevin Reddington, representing Clancy, also asked Judge William Sullivan to look at juror Michael Desronvil’s alleged domestic violence history and use of their cellphone during deliberations, according to a motion obtained by the New Haven Register.

Judge Sullivan has agreed to impound jury information and questionnaires filed before the trial, but has not yet ruled on Reddington’s motion.

Desronvil, a 48-year-old father, was the sole voice on the jury to call for Clancy to be found guilty of murdering her three children, after the other 11 jurors voted for her to be found not guilty due to suffering from postpartum psychosis.

Clancy is due back in Plymouth Superior Court in Massachusetts on Sept. 29, where Reddington is expected to request the charges be dropped since the jury, including Desronvil, allegedly agreed there was reasonable doubt the prosecution had proved its case.

Plymouth County District Attorney Tim Cruz is also expected to announce whether Clancy will face a retrial on Sept. 29.

She faces three counts of first-degree murder in the deaths of Callan, 8 months, Cora, 5, and Dawson, 3, after she strangled them on Jan. 24, 2023, while her then-husband, Patrick Clancy, was out picking up food and running errands.

She then attempted suicide by slitting her wrists and neck and jumping out of a second-story window at the family’s home in Duxbury, Massachusetts, south of Boston.

The fall left her paralysed, and she appeared in the courtroom in a wheelchair throughout her six-week trial.

During a “60 Minutes” interview that aired Sunday night, Patrick Clancy said he believed his ex-wife was suffering from postpartum psychosis when she killed their children.
