Ex-NFL star Marcellus Wiley accused of ‘viciously’ raping woman in new lawsuit
Marcellus Wiley “viciously” raped a 22-year-old college student while he was a member of the Buffalo Bills more than two decades ago, according to an explosive new lawsuit obtained by the California Post.
A woman using the pseudonym “Jane Doe” filed the suit in Los Angeles County on Tuesday, alleging that the former NFL Pro Bowler sexually assaulted her nearly 28 years ago while she was attending USC.
Doe claimed that she first met Wiley, who’s now 51 years old, in February 1999, and the two went on a pair of dates.
“Around that time,” Doe’s lawsuit stated, “Jane told Wiley that she was not sexually active, was sexually inexperienced, and was not interested in or willing to have a romantic relationship with Wiley or anyone.”
Weeks later, Doe claimed that Wiley asked her to join him at a downtown Los Angeles nightclub, and she agreed.
Wiley picked her up outside her USC dorm room and after they had their night out, he “pleaded” with her “to come back with him to his hotel, the Hilton near LAX Airport,” according to the lawsuit.
“Because it was late and she did not have access to her car, Jane agreed to go with Wiley to his hotel,” the lawsuit stated.
While inside the property’s lobby, Wiley allegedly repeatedly pressured Doe to spend the night with him in his hotel room.
“Ultimately,” Doe’s lawsuit stated, “Jane agreed to spend the night in Wiley’s room. In doing so, Jane repeatedly and explicitly told him that she was not interested in having sex and that she was going to go to sleep immediately.
“Wiley told Jane that he understood that they would not have sex and that Jane was going to go to sleep immediately.”
Doe alleged in her suit that once she got to the room, she fell asleep “fully clothed.” However, she said later in the night, Wiley raped her.
“Jane told Wiley to stop and repeated ‘please stop’ several times and told him, ‘You’re not listening to me,’” the lawsuit stated.
Wiley, however, did not stop, according to Doe’s suit.
At one point, Doe claimed in her suit that Wiley “observed her shaking and said, ‘Look at you… keep shaking.’”
Doe said Wiley ultimately gave her a ride back to her dorm room, but on the drive, he informed her “he had ‘the clap’ and that she she should get tested for a sexually transmitted disease.”
She alleged the two “never spoke again.”
Doe stated she received a rape kit after she arrived home that tested “positive for bruising and Wiley’s semen.” She also claimed she filed a police report over the matter, but on April 15, 1999, “the District Attorney called Jane to inform her that Wiley denied Jane’s allegations and that, therefore, no charges would be filed.”
Doe is now suing Wiley for sexual battery, assault, battery and intentional infliction of emotional distress.
“This lawsuit marks the first step toward holding Marcellus Wiley accountable for his horrific abuse of our client,” Doe’s attorney, Noah Werksman, said in a statement to The Post this week. “We look forward to standing beside her as she tells her story in court.”
A message seeking comment from Wiley on the allegations was not immediately returned.
Wiley was previously accused of sexual assault by his estranged wife, Annemarie, in an application for a domestic violence restraining order that was filed earlier this year. Wiley denied her claims at the time, calling them “lies” in a scathing statement.
