A California doctor who ran as a Democrat for Congress used her patients’ medical records to send out campaign propaganda during the 2026 midterm election, a lawsuit has claimed.

Dr. Sonia Devgan-Kacker, who owns Westlake Village Urgent Care, is being sued by former patient Sean Rose.

In the suit he points to a text message he received from the urgent care facility in the middle of Devgan-Kacker’s campaign run for the 26th district seat.  

The message, received in May 2026, starts with a “paid” political ad for “Dr. Sonia” prominently featuring her photo and touting her credentials.

It was followed by a text that reads “the clinic will be open and operating under normal business hours during the campaign,” the papers say.  

The rest of the text allegedly “repeats Dr. Sonia’s credentials” again and includes a link to the doctors campaign.

It ends with a reminder to vote on June 2. Rose notes the phone number on the political ad is for Devgan-Kacker’s campaign, not the clinic, according to the suit.

“It’s unclear why a message about the clinic’s hours would need to come from a congressional campaign and not directly to clinic patients from the clinic itself,” the papers read.

They go on to say that the clinic admitted the campaign used patient records to send the text messages in an email sent to Rose on May 21.

Rose started the email chain questioning if the texts were sent by the clinic, according to the suit.

The clinic responded: “It appears that you were a patient at this urgent care a few years ago, which is how we have your phone number. The text message was sent to all previous patients,” the email in the papers says.

It also says the texts were sent out by a third party service used to send out text blasts.  Later in the day Rose claims he was sent another email attempting to “walk back” the clinic’s response. 

“This later email stated the outreach was geographically targeted to members of the local community and was not intended to identify or contact individuals based on patient status,” the papers say.

Rose disputes that claim, pointing out that when he went to the clinic he lived in District 26, where Devgan-Kacker was running, he has since moved to district 29. 

“If Dr. Sonias’ campaign was using the public voter data, it would have seen that Plaintiff is registered to vote in the 29th district,” the papers say.

The class action suit points to The California Confidentiality of Medical Records Act which states “it prohibits health care providers from disclosing medical information relating to their patients without a patient’s authorization.” 

Rose is seeking statutory and punitive damages along with a judgment that the clinic violated the medical records act. 

Devgan-Kacker filed to run for Congress in January shortly after Congresswoman Julia Brownley announced she wouldn’t seek re-election in the 26th district.

“I’m not a career politician—I solve problems for a living. And I’m running to bring practical leadership, accountability, and real-world experience to Congress.” she said on her campaign website.

Her campaign failed, the doctor didn’t make it past June’s primary. The Post reached out the Devgan-Kacker for comment.
