Gavin Newsom tries to ICE the Constitution, again
Gavin Newsom took an oath to “support and defend” the US Constitution when he became Governor of California. But you wouldn’t know it from his habit of signing unconstitutional bills into law.
The latest example is AB 1627, part of a slew of laws the governor signed targeting federal immigration enforcement.
The law bars US Immigration and Customs Enforcement (ICE) officers “from holding office or being employed as a peace officer” in the State of California if they are accused of “serious misconduct” while enforcing federal immigration law.
“Serious misconduct” is a vague definition. To Democrats, any enforcement of the law — whether immigration law, or other law — is “serious misconduct.”
And, of course, Democrats believe that anything an ICE officer does is “serious misconduct.” Newsom even called immigration enforcement “state-sponsored terrorism” before he backtracked after being challenged by conservative commentator Ben Shapiro.
Apparently Newsom hasn’t learned from his previous failed efforts to target ICE.
Earlier this year, a federal judge blocked another California law Newsom had signed to prohibit federal law enforcement officers from wearing masks. It carved out an exception for state officers.
That, a federal judge said, amounted to discrimination against the feds, in violation of the Constitution.
Newsom then took to social media to claim, falsely, that the court had upheld the law, just because it left standing another provision requiring federal agents to wear badges.
Later, the Ninth Circuit affirmed the lower court’s decision to block the mask ban, saying it violated the Constitution’s Supremacy Clause. In areas of federal jurisdiction, the states cannot tell federal officers what to do.
Newsom lost, badly. He knows discriminating against federal law enforcement is unlawful and unconstitutional.
Yet he is trying again, perhaps trying to impress the Democratic Party presidential primary electorate, and hoping that voters have short memories.
It’s an odd way of making a case for his presidential ambitions.

Say what you will about President Donald Trump: It is undeniable that he ended the crisis at the border, in part by letting ICE do its job.
Would Newsom, as president, throw open the border again? Seems so.
Perhaps he is getting desperate. He is falling behind in early presidential polls, and he’s underwater in a recent poll in his home state.
Whatever the reason, targeting ICE officers for doing their jobs is a sop to the radical left.
It’s also a violation of his oath of office.
